Can I legally revert to my maiden name during divorce?

Many women entering into a divorce do not give much thought to what their name will be when the marriage ends. Others may be on the fence about the issue with pros and cons for either choice clouding the decision. Others still may simply want to get out of the marriage as quickly as possible and never even consider reverting to their maiden names.

Whichever of these issues describes you; it is no cause for anxiety. You can either deal with the name change during your divorce or wait until it is over. As challenging as it is going through a divorce, adjusting to your life afterwards has its own set of challenges. This is why women, and even men who have taken their wife's name, have a choice about when they consider changing their names.

To revert to your maiden name during your divorce, you simply request that the judge presiding over your divorce enter a formal court order to restore your maiden name. Once your divorce is final, the name change order included in the divorce decree will automatically go into effect. You will have to take no further action from that point.

If you do not have a formal order in place, you can still revert to your maiden name pretty easily after your divorce. You can do this on your own or you can simply ask your attorney to help you complete any required steps just as he or she would do with any other divorce issue. Since you wish to go back to a name you have already used before, it is a simple process to have your name legitimized once again in the state of Georgia.
