Cheating and its affect on divorce

People in Georgia who have discovered that their spouses have cheated on them likely have their emotions running high. Some people want to run out and file for divorce right away upon discovering infidelity. However, divorce experts have discussed cheating and the role that it plays in divorces. Whereas some couples might be able to move on after infidelity, others might not, causing their marriages to end in divorce.

Whether cheating is considered a factor in divorce is influenced by whether couples live in a no-fault state or not. For instance, in California adultery is not considered a factor in granting divorces since California is a no-fault state. Essentially, the court does not care whether adultery was a factor in a couple's divorce since they don't have to prove fault by either spouse to get a divorce granted.

However, there is a caveat in no-fault states. If the cheating spouse's bad behavior affects the well-being of the couple's children or puts them in any kind of danger, then courts do take the bad behavior into consideration. The court's primary concern is looking out for the best interest of any children involved.

Divorce experts say that if spouses find out the other one has been cheating, it might be best for them to allow themselves time before making any drastic decisions concerning divorce. For instance, people might want to take time to heal since sometimes couples can work through infidelity issues. Also, they might want to consider the effects that a divorce would have on their children.

Divorce attorneys might be able to assist couples going through with divorces draw up the terms of their settlements. They might be able to help them mediate through issues such as child custody, division of property and alimony.
